These Terms of Use (“Terms”) govern your access to and use of the PEnergy Battery mobile application and related services operated by Pure Energy Battery. By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
The App is intended for adults who own, install, maintain, or service compatible Pure Energy Battery lithium packs and supported BMS modules. You represent that you have authority to connect to and configure any device you access with the App.
The App is a professional utility for battery pack monitoring and service. It is not a consumer social network, payment product, or medical device.
Subject to these Terms, Pure Energy Battery grants you a limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control for legitimate pack monitoring and support purposes under the Pure Energy Battery product line.
You may not:
This US release does not require user registration or sign-in. Some backend identifiers may still be created on the device or server to support device activation, registration, telemetry, diagnostics, firmware eligibility, feedback, AI assistance, and remote assistance. Those practices are described in the Privacy Policy.
You are responsible for:
Battery systems can present electrical, thermal, and fire hazards. Improper configuration, incorrect wiring, incompatible firmware, or unsafe operating conditions can damage equipment or cause injury. The App provides informational and configuration tools; it does not replace qualified installation, electrical codes, or professional service judgment.
If you are unsure about a parameter change or firmware update, stop and contact support before proceeding.
The App may allow you to start a remote assistance session with authorized Pure Energy Battery support personnel.
By starting a session, you authorize support personnel to view live device data, diagnostics, logs, and settings necessary to assist you, and, where the product workflow allows, to guide or perform parameter actions you permit during the session.

Remote assistance depends on network connectivity and is not guaranteed to be available without interruption.
The App may include optional AI chat or AI device analysis features. AI output is for informational support and troubleshooting only. It may be incomplete or inaccurate and must not replace professional electrical, battery, safety, or service judgment.
You agree not to submit passwords, payment data, private keys, confidential third-party information, or content you are not authorized to share in AI prompts. You remain responsible for verifying AI suggestions before applying any battery, BMS, firmware, parameter, wiring, charging, discharging, or maintenance action.
If you submit feedback, text, images, or contact details, you grant Pure Energy Battery a worldwide, royalty-free license to use that content to respond to you and improve products and services. Do not submit unlawful content or information you do not have the right to share.
Firmware packages, parameter templates, and configuration data may be provided through our services for compatible devices only. Applying the wrong firmware or parameters can make a device inoperative or unsafe.
The App may include third-party open-source or commercial components subject to their own licenses. Network infrastructure used for connectivity or remote assistance may process technical data as described in the Privacy Policy.
The App software, related technology, and Pure Energy Battery brand marks are owned by Pure Energy Battery or its licensors. PEnergy Battery is the App name used for this release. These Terms do not transfer ownership of any intellectual property to you.
Our collection and use of information is described in the Privacy Policy. By using the App, you acknowledge that policy. Pure Energy Battery is the data controller for App and backend processing described there.
THE APP AND ALL RELATED SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, PURE ENERGY BATTERY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, error-free, or compatible with every device, network, or BMS configuration, or that telemetry, diagnostics, AI assistance, or remote assistance will detect every fault.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PURE ENERGY BATTERY, AND THEIR OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE APP OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOTAL LIABILITY OF PURE ENERGY BATTERY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID SPECIFICALLY FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, THE LIMITATIONS APPLY TO THE FULLEST EXTENT PERMITTED.
Nothing in these Terms excludes liability that cannot be excluded under applicable law.
To the maximum extent permitted by law, you will defend and indemnify Pure Energy Battery against claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the App, unauthorized device access, unsafe parameter or firmware actions, misuse of AI assistance, or violation of these Terms or applicable law.
We may suspend or terminate access to App services (including backend, firmware distribution, or remote assistance) if we believe you violated these Terms, create risk, or if we discontinue the service. You may stop using the App at any time by uninstalling it.
We may update these Terms from time to time. We will post the updated Terms on this page with a new “Last updated” date. Continued use after an update becomes effective constitutes acceptance of the revised Terms, except where applicable law requires otherwise.
These Terms are governed by the laws of the State of Michigan, United States, without regard to conflict-of-law rules, except where mandatory consumer protection laws of your place of residence apply. Where mandatory law requires otherwise for end users, those mandatory rules control to the required extent.
